Margot Alicks focuses her practice primarily on litigation in the Delaware Court of Chancery and the Delaware Supreme Court concerning corporate governance, corporate control, contractual and other commercial disputes.  In addition, Margot advises entity, director and officer policyholders with respect to D&O insurance issues arising in the context of litigation and alternative dispute resolution.

  • iBasis, Inc. v. Koninklijke KPN N.V., C.A. No. 4774-VCS (represented plaintiff in expedited litigation seeking to enjoin a tender offer)
  • San Antonio Fire & Police Pension Fund v. Amylin Pharma., Inc., C.A. No. 4446-VCL (represented defendants in successfully opposing breach of fiduciary duty claims based on provisions in debt agreements permitting creditors to accelerate outstanding debt upon a change in control of the debtor)
  • CapGen Capital Advisers LLC v. Chalice Fund L.P., C.A. No. 4405-VCS (represented plaintiff in successfully obtaining a default judgment against its member-investors)
  • Baca v. Insight Enterp., Inc., C.A. No. 5105-VCL (represented defendant in successfully moving to dismiss a Section 220 books and records action)
  • Roseton OL, LLC v. Dynegy Holdings, Inc., C.A. No. 6689-VCP (represented defendant in successfully opposing an expedited motion for temporary restraining order by creditors who sought to enjoin an internal restructuring that included the use of bankruptcy remote entities)
