In January 22, 2007, in Simon & Schuster, Inc. v. Advanced Marketing Services, Inc., the Delaware Bankruptcu Court issues a written opinion debying a reclamation creditor’s request for a temporary restratining order against the debtor continuing to sell the reclaiming creditor’s goods. The opinion appears to be the first under the newly-amended section 546(c)(1) of the Bankruptcy Code.
