The Delaware District Court Clarifies Its Order on E-Filing

Earlier today, Chief Judge Stark provided clarification regarding the Delaware District Court’s new filing and service deadline of 6:00 p.m., effective tomorrow, October 16. The 6:00 p.m. deadline will apply to every filing and service deadline in every case in the District of Delaware, other than initial pleadings, including the exchange of discovery requests and discovery responses, even when such requests or responses are hand delivered.

Parties will not be permitted to alter the new deadline on a case-by-case basis. While each judge retains the discretion to set a different deadline with respect to a specific filing, the judges have agreed that this discretion will be exercised sparingly.
